What Are Neighbouring Rights?

 
 
 
 
Performance Neighbouring Rights are the rights to royalties generated from broadcast and/or public performance of sound recordings for Artists who have contributed to musical, vocal or audible performance. This includes featured and non-featured performers, session players and singers. Record companies can also be entitled to such royalties.

Performance Neighbouring Rights exclude the Author and Composer’s portion of income and are not collected by rights organizations such as SACEM, BMI, ASCAP among other songwriter royalty collection societies. Since performance rights are in the “neighbourhood” of Author and Composer Rights, the name Neighbouring Rights was coined.

Can Neighbouring Rights royalties be collected retroactively?

Yes, depending on territorial legislation and individual society’s distribution rules, they can be retroactively claimed ranging from 1 to 10 years, however commonly up to 3 years.
